Terms of Service

A&L Designs LLC is a single-member limited liability company registered in the State of Alaska, operated by Alex Emers, based in Fairbanks, Alaska. We provide website design, development, hosting, and maintenance services to businesses.

We may provide design proposals or mockups during the consultation phase. Here is how those are handled:

Privacy. Design proposals and mockups are shared privately. We don't publish them, index them, or share them with anyone other than you.

Ownership. All design proposals and mockups remain the property of A&L Designs until a project is agreed upon and the initial payment is made. You may view them and share them with people in your business for the purpose of making a decision. You may not copy, reproduce, republish, or hand the design to another developer to build from.

Plan pricing. Website builds start at $850 to begin and then $99/month (Express Launchpad: a one-page high-speed site, mobile-first design, live business hours, tap-to-call buttons, and premium hosting with SSL and daily backups). Larger plans are $1,850 + $149/month (Essential Website) and $3,500 + $199/month (Premium Website), and add multiple pages, local SEO basics, Google Business setup, monthly content and price edits, and priority support. Growth OS plans are $2,800 + $299/month (Core) and $4,800 + $499/month (Dominator).

Method. Payments are processed through Stripe. We accept major credit and debit cards. Payment is made to A&L Designs LLC.

Start payment. The setup payment is due before the full build begins. Start payments are non-refundable once the full build begins.

Late payment. Invoices unpaid after 30 days may be subject to suspension of work or managed services, subject to the cancellation and ownership terms below.

Additional work. Requests outside the agreed scope will be quoted separately and in writing before work begins. Nothing is billed by surprise.

Each build includes custom design, development, mobile optimization, content writing, photo sourcing and preparation, local SEO setup, lead capture forms, analytics installation, and launch on your domain.

The following are not included unless separately agreed:

• Domain registration fees (typically $12–$20 per year, paid by you directly to the registrar in your name)
• Third-party service fees such as online ordering platforms, reservation systems, or booking software
• Third-party subscriptions or services outside the selected plan
• Paid advertising management
• Professional photography or videography
• Content translation
• Custom software or application development

To build your site, we need certain things from you. You agree to:

• Provide accurate business information, including hours, contact details, and services
• Provide or approve content, photos, and branding materials in a reasonable timeframe
• Confirm you own or have the right to use any logos, photos, text, or other materials you give us
• Review and respond to work in a reasonable timeframe
• Provide feedback in consolidated batches rather than piecemeal

You are responsible for the materials you provide. If you supply content, images, or trademarks you don't have the right to use, you are responsible for any resulting claim, and you agree to indemnify A&L Designs against it.

Delays. Timelines assume timely responses from you. If a project stalls for more than 60 days due to lack of response, we may consider it abandoned. Amounts paid on abandoned projects are not refundable, and restarting may require a new quote.

Website builds start at $850 to begin and then $99/month. Online stores are quoted separately and start at $2,500.

Full ownership. Once payment is complete, you own the completed site and your domain remains registered in your name.

Monthly hosting and care are included for both plans at $149/month (Essential) or $199/month (Premium). This includes hosting, SSL, backups, monitoring, and monthly search reporting. Starter includes edits when hours or prices change; Standard includes same-day edits.

No contract. The monthly service may be canceled at any time without a cancellation penalty.

Cancellation. You may cancel at any time. Cancelling ends future monthly billing. Cancelling does not delete your website and does not affect your ownership of it. The completed site stays live and remains yours, and your domain remains in your name.

What it doesn't cover. The selected plan covers the services listed for the selected tier. Redesigns, new features, and work outside that tier's scope are quoted separately.

Legacy pricing. Where a signed agreement specifies a particular hosting rate, that rate is honored for the term of that agreement.

Your domain. Your domain name is registered in your name and belongs to you. We do not hold client domains.

The website. Once all project payments are complete, ownership of the website's frontend code, design, and content transfers to you.

Our tools. We may use certain proprietary tools, libraries, or third-party platforms to build and host your site. You are granted a license to use these as part of your website, but ownership of those tools remains with us or their respective owners.

We reserve the right to suspend or terminate services if:

• Payments are more than 30 days overdue
• You breach these terms
• You use the website for illegal purposes
• Your conduct towards A&L Designs staff is abusive or harassing

If we terminate service for non-payment, we will provide 7 days' notice before the site goes offline.

A&L Designs LLC provides services "as is" and "as available." To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages, including loss of profits, data, or business opportunities, arising from your use of our website or services.

Our total liability for any claim arising out of these terms or our services shall not exceed the total amount you have paid to us in the 12 months preceding the claim.

These terms are governed by the laws of the State of Alaska. Any disputes arising from these terms shall be resolved in the courts of Fairbanks, Alaska.

We may update these terms from time to time. We will notify you of any material changes by posting the new terms on our website and updating the "Last Updated" date.
